Amendment to the Approved Capital Implementation Program of the Albuquerque Bernalillo County Water Utility Authority for the Fiscal Year Ending June 30, 2025

WHEREAS, the Capital Implementation Program is governed by the requirements established under Section 2-1-8, 2006, which provides for amendments to the approved program; and
WHEREAS, appropriations for the Fiscal Year ending June 30, 2025 that were previously approved under R-24-10 and R-24-11 require an amendment to add funding utilizing American Rescue Plan Act (ARPA) award funding under a subrecipient agreement with Bernalillo County; and
WHEREAS, the Bernalillo County approved the Seventh Amendment to the Memorandum of Understanding that adjusts the total ARPA subaward to the Albuquerque Bernalillo County Water Utility Authority to sixty-four million four hundred seventy-six thousand thirty-six dollars and fourteen cents $64,476,036.14; and
WHEREAS, pursuant to the Seventh Amendment, Bernalillo County is dedicating the surplus of funding in the amount of two hundred thousand and no cents ($200,000) from the Carnuel Water System Expansion project to the Carnuel Sewage Collection System project; and
BE IT RESOLVED BY THE WATER AUTHORITY:
Section 1. That the adjustments for the Bernalillo County ARPA projects as stated below are hereby made.
ARPA Carnuel Water System Expansion (Expense) (200,000)
ARPA Carnuel Sewage Collection System (Expense) 200,000
Section 2. For all future funding adjustments for Bernalillo County ARPA projects, the Executive Director or designee is authorized to take the follow actions without additional Board approval:
A. Reallocate already-appropriated ARPA funding from the sub award by Bernalillo County between approved projects for consistency with County amendments to the sub award; and
B. Reclassify already-appropriated ARPA funding from the sub award by Bernalillo County between approved projects for consistency with County amendments to the sub award; and
C. Negotiate and enter into subsequent agreements and amendments with Bernalillo County regarding ARPA funding and to take any other action necessary to carry out the directives of this resolution.
