Amendment to the Approved Capital Implementation Program of the Albuquerque Bernalillo County Water Utility Authority for the Fiscal Year Ending June 30, 2025

WHEREAS, the Capital Implementation Program is governed by the requirements established under Section 2-1-8, 2006, which provides for amendments to the approved program; and
WHEREAS, appropriations for the Fiscal Year ending June 30, 2025 that were previously approved under R-24-10 and R-24-11 require an amendment to add funding utilizing American Rescue Plan Act (ARPA) award funding under a subrecipient agreement with Bernalillo County; and
WHEREAS, Bernalillo County approved the Sixth Amendment to the Memorandum of Understanding that adjusts the total ARPA subaward to the Albuquerque Bernalillo County Water Utility Authority to sixty-four million four hundred seventy-six thousand thirty-six dollars and fourteen cents $64,476,036.14; and
WHEREAS, pursuant to the Sixth Amendment, Bernalillo County is dedicating the surplus of funding in the amount of six hundred and thirty-eight thousand seven hundred two dollars and seventy-eight cents ($638,702.78) from the Kirtland Air Force Base (KAFB) Tijeras Interceptor Rehabilitation project to the Metropolitan Detention Center (MDC) Water and Sewer Improvements project; and
WHEREAS, pursuant to the Sixth Amendment, Bernalillo County is dedicating additional ARPA funding in the amount of six hundred and eight thousand four hundred thirty-eight dollars and fifty-three cents ($608,438.53) which is being appropriated by this Resolution for the Mesa Del Sol Non-Potable Reuse Booster Pump and Reservoir project.
BE IT RESOLVED BY THE WATER AUTHORITY:
Section 1. That the adjustments for the Bernalillo County ARPA projects as stated below are hereby made.

ARPA MDC Water and Sewer Improvements (Expense) 638,702.78
ARPA Mesa Del Sol NP RRPS (Expense) (608,438.53)
ARPA Grants Federal Pass-through (Revenue) 608,438.53
Section 2. That the Executive Director is authorized to negotiate and enter into subsequent agreements and amendments with Bernalillo County regarding ARPA funding and to take any other action necessary to carry out the directives of this resolution.
