Amendment to the Approved Capital Implementation Program of the Albuquerque Bernalillo County Water Utility Authority for the Fiscal Year Ending June 30, 2024

WHEREAS, the Capital Implementation Program is governed by the requirements established under Section 2-1-8, 2006, which provides for amendments to the approved program; and
WHEREAS, appropriations for the Fiscal Year ending June 30, 2024 that were previously approved under R-23-10 and R-23-11 require an amendment to add funding utilizing American Rescue Plan Act (ARPA) award funding under a subrecipient agreement with Bernalillo County; and
WHEREAS, the Bernalillo County approved the Third Amendment to the Memorandum of Understanding that adjusts the total ARPA subaward to the Water Authority to sixty-three million two hundred eighty-nine thousand six hundred fifty-nine dollars ($63,289,659.00); and
WHEREAS, pursuant to the Third Amendment, Bernalillo County is dedicating additional ARPA funding in the amount of seven million four hundred and seventy-three thousand and eighty-six dollars ($7,473,086) which is being appropriated by this resolution for MDC Water & Sewer Improvements.
BE IT RESOLVED BY THE WATER AUTHORITY:
Section 1. That the adjustments for the Bernalillo County ARPA projects as stated below are hereby made.
ARPA MDC Water & Sewer Imprv. (Appropriation) 7,473,086
ARPA Grants Federal Pass-through (Revenue) 7,473,086
Section 2. That the Executive Director is authorized to negotiate and enter into subsequent agreements and amendments with Bernalillo County regarding ARPA funding and to take any other action necessary to carry out the directives of this resolution.
