Authorizing an Amendment to Development Agreement for Water and Sewer Service with Buglo Properties LLC for Paradise View Universal Apartments

WHEREAS, Buglo Properties LLC is the developer and owner of real property of a parcel (Lot 12A) near Unser and Paradise for which the Water Authority previously approved a development agreement for water and wastewater service to be provided by resolution R-17-6, as a 12-unit apartment complex; and
WHEREAS, since the passing of R-17-6, Buglo Properties LLC has acquired two lots (Lot 10A and Lot11A) adjacent and contiguous to the original parcel and now has the capability to build an additional 24-units, which will utilize the existing services previously approved in the original development agreement; and
WHEREAS, this amendment to the development agreement will incur no net expense to the Water Authority and be subject to provisions of relevant updated planning documents as approved by the City and/or County; and
BE IT RESOLVED BY THE WATER AUTHORITY:
Section 1. That the original development agreement previously authorized for Buglo Properties LLC in R-17-6 is hereby amended to allow an additional 24-units on the parcels described herein, which will utilize the existing services.
Section 2. All other provisions of the original development agreement will remain in full force and effect and the Water Authority shall incur no net expense. The development shall be subject to current Utility Expansion and Water Supply Charges.
Section 3. Buglo Properties LLC shall continue to be responsible for close coordination of the project with the Water Authority during the design and construction phases, including the review of the design details during the design process, and the approval of specifications and contract documents.
