Approving an Intergovernmental Agreement Between Bernalillo County and the Albuquerque Bernalillo County Water Utility Authority for the Carnuel, NM Sewer Collection System

WHEREAS, the Albuquerque Bernalillo County Water Utility Authority ("Water Authority") is undertaking the design and implementation of a new sanitary sewer collection system in Carnuel, New Mexico, and has requested financial assistance from Bernalillo County ("County") to support this effort; and
WHEREAS, the County wishes to contribute funding toward the design phase of the Carnuel Sewer Collection System ("Project"), which will fulfill the required match for a Congressional Direct Spending request and allow the Project to move forward; and
WHEREAS, the Parties have negotiated an Intergovernmental Agreement ("Agreement") under which the County will provide financial support and the Water Authority will perform the services necessary to advance the Project; and
WHEREAS, the Agreement provides that the County shall compensate the Water Authority in an amount not to exceed three hundred thousand dollars ($300,000) for services rendered in support of the Project; and
WHEREAS, the Agreement establishes the responsibilities of each Party, the term of the Agreement, reporting requirements, audit provisions, and other standard terms governing intergovernmental cooperation; and
WHEREAS, the Board of County Commissioners finds that entering into this Agreement promotes the public health, safety, and welfare of residents in the Carnuel community and supports essential infrastructure development within Bernalillo County.
BE IT RESOLVED BY THE WATER AUTHORITY:
Section 1. The Intergovernmental Agreement between Bernalillo County and the Albuquerque Bernalillo County Water Utility Authority for the Carnuel, NM Sewer Collection System is hereby approved.
