Amendment to the Approved Capital Implementation Program of the Albuquerque Bernalillo County Water Utility Authority for the Fiscal Year Ending June 30, 2024 to add funding for the To’Hajiilee Pipeline Project

WHEREAS, the Capital Implementation Program is governed by the requirements established under Section 2-1-8, 2006, which provides for amendments to the approved program; and
WHEREAS, appropriations for the Fiscal Year ending June 30, 2024 that were previously approved under R-23-10 and R-23-11 require an amendment to add additional funding for the To’Hajiilee Pipeline Project to utilize State of New Mexico Department of Indian Affairs Fund 89200 Capital Appropriation Project Tribal Infrastructure award funding under a subrecipient agreement with the Navajo Nation; and
WHEREAS, the Water Authority’s utilization of the additional funding is subject to approval by the Navajo Nation of a Reimbursement Agreement in the amount of Three Million Five Hundred Sixty-Eight Thousand One Hundred Eighty Dollars ($3,568,180) for the To’Hajiilee Pipeline Project; and
BE IT RESOLVED BY THE WATER AUTHORITY:
Section 1. That the adjustments for the To’Hajiilee Pipeline Project are hereby made.

Section 2. That the Executive Director is authorized to negotiate and enter into an agreement with the Navajo Nation and to take any other action necessary to carry out the directives of this resolution.
