Approving an Agreement between the U.S. Department of the Interior, Bureau of Reclamation and the Albuquerque Bernalillo County Water Utility Authority to Payback 5,000 Acre-feet of Water Owed Under the 2000 Agreed Order

The Bureau of Reclamation (Reclamation) owes the Water Authority 15,600 acre-feet of water that was provided under an Agreed Federal Court Order in 2000.  This agreement provides for Reclamation repayment of 5,000 acre-feet of Relinquishment Credit Water to the Water Authority to fulfill their obligation under the Federal Court Order.

 

Reclamation has paid the Water Authority for the 10,600 acre-feet under a lease agreement for $100 per acre-foot.  In the event that Reclamation cannot obtain approval for transferring the Relinquishment Credit Water to the Water Authority, Reclamation agrees to repay the Water Authority with San Juan-Chama water which would be delivered at a later date.

 

We are requesting approval of the Agreement and to delegate responsibility for finalizing the final terms and conditions if necessary to the Executive Director.  The Water Authority will be responsible for obtaining permits and environmental approvals for storing the water in Abiquiu Reservoir.
