Authorizing Amendment to the 2007 Agreement with Western Albuquerque Land Holdings for the Antelope Site

WHEREAS, Western Albuquerque Land Holdings, LLC (WALH) desires provide water and sewer service to an approximate 464 acre tract of land commonly referred to as the Antelope Site located west of Atrisco Vista Blvd and north of Interstate 40; and
WHEREAS, the Antelope Site received approval in September 2016 of an amendment to the Westland Master Plan and zoning from the Bernalillo County Commission; and
WHEREAS, the Antelope Site which is located outside the service area of the Albuquerque Bernalillo County Water Utility Authority (the Water Authority) will require an amendment to the 2007 development agreement for the extension and/or connection of water and sewer lines to the Water Authority's water and sewer system; and
WHEREAS, the Water Authority's Water and Wastewater System Expansion Ordinance requires that new service developed outside the Water Authority's service area will incur no net expense to the Water Authority and be subject to provisions of relevant updated planning documents as approved by the City and/or County; and
BE IT RESOLVED BY THE WATER AUTHORITY:
Section 1. WALH will obtain all permits, assurances, and approvals from the Water Authority and the Bernalillo County development/design review process. Construction of water and/or sewer lines shall be in conformance with the plans approved by the Water Authority and all applicable plans, specifications, requirements, and standards of the Water Authority.
Section 2. The expansion of the System shall incur no net expense to the Water Authority and be subject to current Utility Expansion and Water Supply Charges.
