Adopting a Utility Franchise Agreement with the Village of Los Ranchos de Albuquerque, New Mexico

WHEREAS, the Village of Los Ranchos de Albuquerque, New Mexico (“Village”) is a municipal corporation which is authorized to grant a franchise to the Albuquerque Bernalillo County Water Utility Authority (“Water Authority”) for the provision of water and wastewater service and construction, maintenance and operation of the Water Authority’s facilities and distribution systems within the Village’s streets and public rights-of-way; and,
WHEREAS, the Village has had a franchise agreement with the Water Authority which was continued on an implied basis since its expiration date; and,
WHEREAS, the Village and the Water Authority desire to extend the existing franchise agreement under the terms adopted by the parties in a successor franchise agreement.
BE IT RESOLVED BY THE WATER AUTHORITY:
That the Albuquerque Bernalillo County Water Utility Authority hereby adopts the franchise agreement adopted on November 9, 2022, by the Governing Body of the Village of Los Ranchos de Albuquerque, Ordinance No. 291.
